1. Service Description
Gresh is a privacy-first personal journal application offering journal recording, content synchronization, and end-to-end encryption. We may update, adjust, or add new features at any time.
2. Account and Security
2.1 Account Registration and Login
- You need to register and log in using an email address.
- You must ensure that the information you provide is truthful, lawful, and valid, and update it promptly as needed.
2.2 Account Security
- You are responsible for safeguarding your account credentials and for all activities conducted under your account.
- If you discover that your account has been compromised or that there is a security risk, please contact [email protected] as soon as possible.
2.3 Eligibility and Age Requirements
You confirm that you have full legal capacity to use the Service, or that you have obtained the consent of a guardian where required by applicable law. The Service is not intended for children under 13 years of age (or the minimum age required by the laws of your jurisdiction).
3. License and Restrictions
3.1 License
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use Gresh for personal, non-commercial purposes only.
3.2 Prohibited Conduct
You may not engage in the following activities (including but not limited to):
- Reverse engineering, decompiling, cracking, circumventing security mechanisms, or tampering with the client or server.
- Unauthorized access to, probing, or attacking our systems, interfaces, or networks.
- Uploading or distributing illegal, violent, pornographic, hateful, harassing, or infringing content.
- Using automated programs to make bulk requests, scrape data, or overload interfaces, affecting service stability.
- Any conduct that violates applicable laws or infringes upon the legitimate rights of third parties.
We reserve the right to restrict functionality, suspend, or terminate the Service in accordance with applicable law or this Agreement.
4. User Content and Ownership
4.1 User Content Ownership
Copyright and related rights in journals and content you create or upload in Gresh ("User Content") belong to you or the relevant rights holders.
4.2 License to Provide the Service
To provide the Service to you (e.g., storage, synchronization, display, backup, format conversion), you grant us the right to process your User Content to the extent necessary.
The above authorization is limited to what is necessary to provide the Service, does not constitute a transfer of ownership of your content, and does not authorize us to use your content for advertising purposes or to sell it to third parties.
5. Account Deletion and 7-Day Cooling-Off Period
To prevent permanent data loss due to accidental operations, Gresh provides a 7-day cooling-off period for account deletion:
- You can submit a deletion request on the App's settings page.
- After submission, your account may be forcibly logged out and will enter a "pre-deletion/cooling-off" state.
- During the cooling-off period (within 7 days), you can log in to cancel the deletion and resume use.
- After the cooling-off period ends, your account and data (including journal content) may be permanently deleted or irreversibly processed and cannot be recovered.
You understand and agree that any data deletion and loss resulting from your failure to cancel the deletion during the cooling-off period is your sole responsibility.
6. Service Interruption, Changes, and Termination
We will endeavor to provide stable service, but you understand and agree that:
- Service interruptions may occur due to maintenance, upgrades, failures, force majeure, or third-party causes, and we may not be able to guarantee completely uninterrupted service.
- We may modify features, interfaces, or discontinue certain services as part of business adjustments.
- If you violate this Agreement or applicable law, we reserve the right to restrict or terminate your access to the Service.
7. Limitation of Liability
To the maximum extent permitted by applicable law:
- Gresh is provided on an "AS IS" basis. We make no warranty regarding the complete suitability, error-free operation, or uninterrupted availability of the Service.
- We shall not be liable for indirect losses, lost profits, data loss, or other consequential damages (except as required by law).
- For problems caused by third-party services (such as cloud services, etc.), we will provide reasonable assistance but are not liable for the actions of such third parties.
7.1 Data Backup and End-to-End Encryption Risk Notice (Important)
- You understand and agree that any digital service may experience data loss due to device failure, user error, system upgrades, force majeure, or third-party causes.
- If you enable end-to-end encryption (E2EE), you must safeguard your recovery/decryption credentials. We are generally unable to help you recover plaintext content if you lose your credentials.
8. Privacy Policy
The processing of your personal information is governed by the Gresh Privacy Policy. By using the Service, you consent to our processing of your information in accordance with the Privacy Policy.
9. Indemnification
To the extent permitted by law, if Mustica suffers claims, losses, liabilities, or expenses (including reasonable attorney's fees) as a result of your violation of this Agreement, violation of applicable law, or infringement of third-party rights, you agree to indemnify and hold Mustica harmless.
10. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of laws principles.
In the event of a dispute, both parties shall first notify each other in writing and attempt to resolve the dispute amicably (negotiation period of no less than 30 days). If negotiation fails, either party may submit the dispute to the federal or state courts of competent jurisdiction located in Sheridan County, Wyoming, United States.
For EU/UK Users: The above dispute resolution provisions do not affect your rights under applicable consumer protection laws, including the right to file complaints with local regulatory authorities.
11. Changes to This Agreement
We may update this Agreement from time to time. Updated versions will be published through the App or website with an updated "Effective Date." If changes are material, we will notify you in a more prominent manner. Your continued use of the Service constitutes acceptance of the updated Agreement.
